RI Supreme Court says yacht club can run marina

Rhode Island's Supreme Court says a yacht club in Tiverton may operate its marina, overturning a lower court's decision.

A Rhode Island Superior Court judge had ruled the marina illegal. The judge called it part of the club's main property, whose zoning designation it violated.

In a 4-0 opinion issued Friday, with one justice abstaining, the court says the Tiverton Yacht Club's marina is a separate property.

The Supreme Court did not rule on the lower court's judgment that the yacht club's plans to rebuild and expand its clubhouse - destroyed in a 2003 fire - violated zoning rules. The Tiverton Town Council amended zoning of that property in fall 2010 to facilitate construction, rendering the Superior Court ruling moot.
