RI lawmakers adopt indoor prostitution ban

PROVIDENCE—Rhode Island would close a legal loophole allowing prostitutes to ply their trade indoors under legislation that state lawmakers approved Thursday and is headed to Gov. Don Carcieri, who is expected to sign it.

The legislation would make prostitution a misdemeanor offense regardless of where it occurs. Prostitutes would face a maximum six-month prison sentence for a first offense, while prostitutes convicted of a subsequent offense and customers would face up to a year.

State lawmakers accidentally legalized indoor prostitution in 1980. Trying to crack down on rampant outdoor solicitations in a Providence neighborhood, they passed a law that targeted prostitutes and their customers operating in public. But the statute was silent on those who operate inside, making Rhode Island the only place outside parts of Nevada where the practice is legal.

State Sen. Harold Metts, D-Providence, urged lawmakers to adopt the ban even though several of his colleagues argued it would unfairly penalize destitute women. He recalled how his mother was harassed years ago by men trying to buy sex as she returned home from her factory job. At the time, he was a teenager in a baseball league.

“I’d have to come out with my bat,“ he said. “As much compassion as I have for people that are trying to survive, it’s the impact that happens to the rest of us.“

Opponents have warned criminalizing indoor prostitution will make the lives of drug-addicted or impoverished women harder, and possibly make victims of human trafficking more reluctant to seek medical help or legal assistance for fear of being reported.

“It’s difficult to support a law that lumps victims in essentially the same category as offenders,“ said Laura Pisaturo, director of advocacy and legal services for Day One, which helps victims of sexual abuse and violence. Her organization would support a law that jailed customers but not prostitutes.

More than two dozen suspected brothels operate in Rhode Island, including many thinly disguised as Asian massage parlors advertising services such as table showers or body rubs. Courts have dismissed charges against prostitutes arrested by police in brothels raids even when they admit offering sex-for-cash because it isn’t illegal.

Michael Kiselica, an attorney who has represented brothel owners and their landlords, said his clients may sue the state if the bill becomes law. He said there will be unintended economic consequences.

“What happens when you suddenly create a large number of unemployed people who the day before were gainfully and lawfully employed?“ he said. “What consideration did the state give to those people?“

The presence of brothels has become an eyesore for some in the state.

Hema Bulmer and her husband, Eric, decided in August to relocate their science education store for children after clashing with a suspected brothel that opened beside them in a strip mall in Middletown, a suburb on Aquidneck Island.

Bulmer said her husband found hypodermic needles outside the alleged brothel, which seemed to operate late at night and only attracted men. They found online reviews describing the sexual services offered there.

Last November, an Asian woman who spoke only broken English walked into the couple’s store and used hand gestures to explain what occurred next door, Bulmer said. The woman asked the couple to call police for help but left before an officer arrived.

“We had no clue there’s no law,“ said Bulmer, who wants an anti-prostitution law passed. “We thought the police would be able to help.“

Does this mean that what the politicians and lobbyists do behind closed doors will be punishable under the law? Wow, I’d never thought our politicians who are of such high moral character; that they had it in them. Not to threat ladies of the evening, you should all run for office, yeah, make money through RI’s true oldest profession. Although, making money this way, could be way scarier than worrying about catching something from some customer. My Mom always told me never to shake a politicians hand (you never know where it has been) apparently, as it turns out, they not only have had them in our pockets, but with this additional law, they have placed them on our privates as well. However, I think the ulterior motive isn’t the health and welfare of women, but to find ways to redirect that extra money into the coffers of the state and into the hands of our politicians. You want to see prostitution in action, in public view, and advertised widely; go to Twin Rivers on any night, and see the state pimping for money. Hey, perhaps there’s a partnership here. RI style. Dress up in rabbit ears ladies, and run around the track….here’s Rhody!!! One a more serious note, yes people, Remove ALL incumbents, vote third party where possible. Let’s have REAL change. WE ARE CHANGE.

KM826: I read the post you are referring to as well. I would like to think the person who wrote that means what I meant (my post was just before it). And that is to encourage the people that don’t vote/aren’t registered to do so to REMOVE ALL the encumbents. It’s obvious we can’t always pick a winner, but we sure can dump the loser. We should adopt the “One and Done” mentality with those who ARE elected that don’t produce.

First off, I read a comment a few pages back that said something to the effect of that if you don’t vote you have no right to complain. That is a bunch of nonsense. The people who do not vote may not be responsible for electing decent politicians (if any exists) but at least they are not responsible for electing dishonest, greedy, politicians who not only play the system but also play the taxpayers. I am a registered voter and in my votiing experience when it comes time to choose who I am going to vote for instead of being able to choose who is best for the job I have to choose the lesser between all the evils. Why??? Because it is rare to get a decent politician to even make it past the primaries. The reason for that is because people are always being encouraged, usually by a politician or a political group, to go out and vote but when was the last time you heard of a politician or political group encouraging people to become informed and make intelligent decisions at the polls???

Anyway, back to this prositution thing. As long as prositution is legal indoors and is kept off the streets there really is no problem. It’s legal to sleep with whoever you want, whenever you want, for any reason except for monetary gain. Why should it be illegal to sell something that is legal to give away? At least with prositution being legal it will provide income for prositutes that is not coming from our government. Besides, having a woman sleep around, get knocked up, not know who the father is, and to live off of taxpayer money to support not only her baby but herself is perfectly legal. Just like it is perfectly legal for children to be brought into this world for the sole purpose of providing their parent with more welfare money.

Prostitution isn’t the most respectable occupation out there but take a look at some of the other ways people make their money. Besides people using sex and their children to make money alot of people steal from hardworking people, deal drugs, and also fake or exaggerate mental and/or physical conditions in order not to work and collect money from the government.

At least when a prositute gets paid it’s not from Rhode Island taxpayers. Unless, an elected politician is their john.

Anyone with your intelligence is someone I would not take a suggestion from. I am a very respectful person you critisized me for posting that veto section 14. It insulted you I guess because you don’t know squat about politics in RI. So you are the attacker here.
