Warwick woman sentenced in 2007 killing

NEWPORT, R.I.—A Rhode Island woman has been sentenced to 20 years in prison after pleading guilty to second-degree murder for suffocating the elderly man she lived with and cared for.
Heather Catterall was sentenced Wednesday to 20 years behind bars to be followed by 20 years of probation for killing 76-year-old Albert Dubois in July 2007 in the Warwick home they shared.
Authorities say Catterall, 28 at the time, smothered Dubois with a plastic bag while he was sleeping after a fight over money.
Her defense attorney said she at first cooked and cleaned for Dubois, but he soon began asking for sexual favors in exchange for pain medication and money to feed her drug addiction.
The judge said Catterall has shown remorse and has tried to rehabilitate herself.

It was first degree. They plead justice away just to get a conviction.
Ok now here I have to wonder why that is not First degree murder. Waiting until he is asleep is not heat of passion OR self defense.
