PROVIDENCE—A man who struck his girlfriend’s 3-year-old nephew because he blamed the toddler for making a mess in his apartment was convicted Thursday of second-degree murder in a case that led to a review of Rhode Island’s foster care system.

Delestre, 27, testified that he hit Thomas “T.J.“ Wright on the head in 2004, causing the child to flip backward down a staircase and lose consciousness. But he said he did not intend to kill the boy, and had asked jurors to convict him of manslaughter instead of murder.

The jury deliberated for more than one day before returning the verdict. Delestre also was convicted of conspiracy to commit murder and faces a maximum sentence of life in prison, plus 10 years, when sentenced.

Prosecutors said Delestre and his girlfriend, Katherine Bunnell, took turns beating the toddler early on Oct. 30, 2004, after they returned from a night out drinking and found a mess of eggs, yogurt, milk and feces in the living room and kitchen of their Woonsocket apartment.

The 32-pound toddler was pulled off life support the following day and died of brain injuries and internal bleeding.

Delestre testified that he tried but failed to catch the boy as he fell down the stairs and then lied to police by blaming the teenage babysitter.

Bunnell - who blamed Delestre for inflicting Wright’s fatal injuries - was convicted in May of second-degree murder and sentenced to life in prison with the possibility of parole. She’ll be eligible for parole in under 25 years.

Wright and his two brothers were placed with the couple because their mother was in prison out of state. The state was processing the couple’s license as foster parents when the death occurred.

“What a tragedy for everybody,“ Delestre’s attorney, Robert Mann, told reporters after the verdict, adding that his client was remorseful and had taken responsibility.

Mann said he was relieved Delestre was acquitted of first-degree murder but had hoped for a lesser manslaughter conviction. Delestre and his attorney have not decided whether to appeal.

Attorney General Patrick Lynch said in a written statement that he was disappointed by the verdict because it “does not adequately address the depth of his involvement or the darkness of his crime.“

The case sparked a review of Rhode Island’s foster care system and is cited in a pending federal lawsuit alleging that children in state custody have been sexually abused, assaulted and shuttled from home to home.

The head of the state Department of Children, Youth and Families, which was criticized for the boy’s death and its night-to-night placement of foster children, was replaced by the governor in January 2005.

A state panel that investigated the death concluded the state should never have placed the boys with Bunnell and Delestre, who each had juvenile records, were unemployed and were already raising their own two children.

“It was a tragedy waiting to happen,“ said Jametta Alston, the state’s child advocate, whose office convened the panel.

The panel report identified at least five missed opportunities to protect Wright. It also offered 15 recommendations, such as reducing caseworkers’ workloads and conducting thorough background checks before foster children are placed with relatives.

Alston said there have been improvements in the foster care system, but flaws remain.

“I sit at my desk and wonder if this will ever happen again,“ she said.

I believe it is a tragedy that Mr Delestre was not convicted of 1st degree murder, but I suppose the jury had it’s reasons for not doing so.  I don’t believe he should ever be eligible for parole..someone like him should not be allowed to live in our society. What that little boy went through was horrific.

I feel there were many things that contributed to this tragedy.  DCYF I think was the beginning….those 2 people should never have been certified
as foster parents having previously been found guilty of possessing marijuana etc. 
Secondly I have often wondered in reading about both trials (that of Bunnell and Delestre) why the babysitter had left that mess on the rug..why it was never picked up and it seems noone ever questioned that.  Maybe things would have ended differently had she done so.

I completely agree with kilroy. They need the death penalty for animals like those 2. This state would rather keep taking our tax dollars to support these animals instead of getting rid of them like they got rid of that little boy. And she hardly got any kind of punishment for her role in it, what a disgrace! The la??DEFINATELY against the hard working good people in this state!

Does anyone have any info about the babysitter? I’m interested in who that was and what the issue is with picking up after a 3 year old.  It’s a part of babysitting. That person allowed a “mess” in the house to happen. Left it there knowing these people and their reaction I would bet and didn’t care. And what about neighbors? They didnt hear anything going on?  It seems there are more guilty parties here than just two unfortunately. You know this was not the first time this child was hurt at the hands of these two people. This whole thing makes me sick. That little boy could not defend himself against these two animals. And he only did what 3 year old do- play and make messes!

THE LITTLE BOY SHOULD HAVE NEVER BEEN PLACED WITH THEM!! WHY WAS HE? THEY HAD A BAD RECORD. DIDN;T THEY SEE THAT WHEN THEY DID A CRIMMINAL CHECK? OH WAIT. THEY CLAIM THAT THEY ARE UNDERSTAFFED AND TOO MUCH WORK. WELL SHAME ON THEM FOR NOT DOING THEIR JOB. AND THAT SCUM OF THE EARTH THAT KILLED THE LITTLE BOY I HOPE HE ROTS IN H***! THE LITTLE BOY DID NOT DESERVE IT!! MAYBE WE CAN BE A LITTLE MORE CAREFUL ON WHERE WE PLACE ALL THE LITTLE KIDS….

hope he gets tortured in the ACI… Hope he has a nice Christmas being someone’s b**ch.. Poor little kid did not have a chance in life. His mom was in the ACI when this happened.. how did the little boy end up with such scum bag losers..

First we get the scum who stomped his 8-month old baby boy in Newport and now this complete waste of oxygen killing a 3-year old boy.  Crimes like this against a child deserve the DEATH PENALTY. 

But, of course, this dimwitted liberal state doesn’t have the death penalty because they care more for the rights of the perpetrators than those of the victims.  What the heck, the kid is dead right?  How much do you want to be that the cretin Delestre and the disgusting excuse for a mother get the minimum jail time?

Those of you who think the death penalty is not a deterrent are 100% wrong.  It is a deterrent to the perpetrator being put to death because he will absolutely, positively not be able to commit that crime or any crime again.  Now that’s deterrence!

Both of them deserve to be beaten like what they did to that little boy. I have no sympathy for this low life. He should be punished to the fullest extent of the law.
